USCIS Begins Accepting H-1B Petitions For FY 2011

U.S. Citizenship and Immigration Services (USCIS) has begun accepting H-1B petitions on April 1, 2010 that are subject to the FY 2011 cap. Petitions subject to the FY 2011 cap must request a start date on or after October 1, 2010, the first day of the fiscal year.

Employers may file an H-1B petition no more than 6-months in advance of the requested start date. Thus, petitions seeking an FY 2011 H-1B cap number with an Oct. 1, 2010 start date can be filed no sooner than April 1, 2010.

As was the case last year, if the quotas for standard and advanced-degree petitions are not reached in this period, the USCIS will continue to accept H-1B petitions until it determines that it has received sufficient filings to meet the cap for the year. If USCIS receives enough cases to reach the 65,000 standard cap during the first five business days, it will use a lottery to select the cases that are awarded quota numbers.

  2. It would be nice if you could also give us more details on the different types of H1B work visas. I think many would be interested to learn those specially for first time applicants wanting to work in the US but they don't have any idea what type of visa to apply for.
